Background

The establishment of the protection and support mechanism stems from the authority of the human rights mandate quoted in UNMIK Regulation No. 2006/12. 1999/1 of 25 July 1999 as amended by the Provisional Authority of Kosovo and UNMIK Regulation no. 2000/15 on the Establishment of the Administrative Department of Justice, and oversees the Office of the Victim Assistance Coordinator established by UNMIK Regulation No. 2000/15. 2001/4 on the Prohibition of Trafficking in Persons in Kosovo, UNMIK Regulation no. 2003/12 on Protection against Domestic Violence.
The office functioned within the Department of Justice under UNMIK since 2002, then with the establishment of Kosovo institutions, the office moved from the Ministry of Justice to the Department of Access to Justice until November 2011 when the State Prosecutor and Minister The Ministry of Justice concludes a Memorandum of Understanding on the transfer of VAAOs from the Ministry of Justice to the Office of the Chief State Prosecutor.

Mandate

The Office for Victim Assistance and Advocacy provides services to victims of crime during legal proceedings and represents their interests in the criminal justice system in Kosovo.

Activities of the OAAV

The Office for Victim Assistance and Advocacy (OAAV) operates independently within the Office of the Chief State Prosecutor. OAAV ensures that its policies align with those of the Office of the Chief State Prosecutor and the Kosovo Prosecutorial Council.

OAAV serves as the Central Office seated in Pristina, with seven regional branch offices situated inside Basic Prosecution Offices.

Victim Advocates operate and are available 24/7, covering the entire territory of Kosovo.

The Office for Victim Assistance and Advocacy helps and represents victims of various crimes, including domestic violence, trafficking in humans, child abuse, rape, murder, and other crimes. They represent victims in interactions with the Police, Prosecution Office, and Courts.

Mandate of the Office for Protection and Assistance to Victims

Office for Victim Assistance and Advocacy’ mandate is to institutionalize the rights of crime victims, offering them representation, counseling, and support to access the justice system.

Victim Advocates are authorized persons to provide support and assistance to victims, ensuring they can participate in legal proceedings. They also have the authority to notify victims of their rights, represent their interests in proceedings, refer them to other service providers, and take action to protect their rights and guarantee to advocate them.

The Office for Assistance and Advocacy to Victims functions as an independent Office within the Office of the Chief State Prosecutor and is led by the Head of the Office for Assistance and Advocacy to Victims as Central Office in Prishtina and also has 7 branch offices situated at the Basic Prosecution Offices as regional offices as well as the Helpline Office.

It functions within the Office for Assistance and Advocacy to Victims – OAAV, which was initially supported by the Organization for Security and European Cooperation (OSCE), and its number is a public and free telephone number, so it is a confidential mechanism for reporting various criminal offenses of Abuse, refers, advises, informs victims and other persons regarding their rights, provides the necessary information for existing services and the contact numbers of the working network.
