Prizren, June 6, 2024 – The Basic Prosecution Office in Prizren, Department of Serious Crimes, has filed an indictment against the defendants I.G., B.R., due to the well-founded suspicion that they have committed the criminal offense “Abuse of official position or authority” under Article 414, paragraph 1 related to article 31, of the Criminal Code of the Republic of Kosovo (CCRK).
According to the indictment, dated 04.04.2022 in Prizren, in the capacity of official persons – the defendant I.G., as manager of the Unit for Human Resources Management within the Municipality of Prizren, and the defendant B.R., as a senior personnel officer of the Unit in question – at the same time as members of the recruiting committee regarding the competition announced by the Municipality of Prizren on 03.03.2022 – published on 04.04.2022 – for the recruitment of 12 general practitioners in the HCMFs, of the Municipality of of Prizren, using official duty or authority, in complicity, do not fulfill official duties in order for the other person to benefit financially, or in order to cause damage or even violate the rights of other persons – other competing candidates, in such a way that during the checking of the application files of the competing candidates in the competition in question, deliberately neglect the criterion of the work license provided as one of the basic criteria according to the competition in question, so that even though the competing candidates A.N., B.M., A.G., and V.M., from the moment of application until the closing of the competition deadline, were not equipped with a work license, they nevertheless approve the application file as regular, so that contrary to the previous conditions of the competition, enable the candidates in question to take part in the written and oral test, as well as to be selected as the winning candidates for the job as a general practitioner physician, according to the Decision taken by the Selection Committee dated 19.07.2022, which then proves that the A.N. candidate is equipped with work license 10 days after the closing of the competition in question, namely on 21.04.2022.
In this way, the defendants I.G. and B.R., have committed the criminal offense of “Abuse of official position or authority” under the CCRK.
The prosecutor of the case, when the indictment was filed, proposed to the Court that after holding the main trial, administration of the evidence and their evaluation, the aforementioned defendants for the criminal offense for which they are accused should be declared guilty and punished according to the law.
