Gjakovë, 24 June 2024 – The Basic Prosecutor’s Office in Gjakovë, Department for Serious Crimes, has filed an indictment, against the defendant Sh.A., for the criminal offense “Aggravated attempted murder” from article 173 par.1 under par.1.5 related to article 28 of the KPRK and for the criminal offense “Unauthorized ownership, control or possession of weapons”, from article 366 par.1 of the CCRK, while for the defendant J.M., for the criminal offense “Assisting in the commission of the criminal offense of aggravated attempted murder “from article 173 par.1 under par.1.5 related to article 28 and 33 of CCRK.
According to point I of the provision of the indictment, among other things, the defendant Sh.A., on 10.03.2024 at 00:13 in Gjakovë, in the restaurant “R…”, intentionally attempted to deprive the life of the injured D.S., J.S., and F.Zh., all three from Gjakova.
With these actions, he has committed the criminal offense “Assisting in the commission of the criminal offense of aggravated attempted murder” from article 173 par.1 under par.1.5 related to article 28 of CCRK.
According to point II of the provision of the indictment, among other things, it states that the defendant Sh.A., has kept the weapon in unauthorized possession, in violation of article 4 par.1 under par.1.1 of the Law on weapons of the Republic of Kosovo.
With these actions, he has committed the criminal offense “Unauthorized ownership, control or possession of weapons”, from article 366 par.1 of the CCRK.
According to point III of the provision of the indictment, among other things, it is alleged that the defendant J.M. willfully helps the defendant Sh.A, by sending him the means of committing the criminal offense – the weapon which the defendant J.M. possessed with a permit.
With these actions, the same person has committed the criminal offense “Assisting in the commission of the criminal offense of aggravated attempted murder” from article 173 par.1 under par.1.5 related to articles 28 and 33 of CCRK.
The prosecutor of the case, when the indictment was filed, proposed to the court that the defendants be found guilty and punished according to the law for the criminal offenses that are charged.
