Background

The State Prosecutor is an independent institution, with authority and responsibility for the criminal prosecution of persons accused of any criminal offense or any other offense, as regulated by law. The State Prosecutor is an impartial institution, and acts on the basis of the Constitution and the law. The organization, powers and duties of the State Prosecutor are regulated by law. The State Prosecutor reflects the multi-ethnic composition of the Republic of Kosovo and respects the principles of gender equality. The initial mandate for a prosecutor is three years. In case of re-appointment, the mandate is permanent until retirement age, as defined by law, unless dismissed in accordance with the law.

Mission

The State Prosecutor is an independent institution and performs its functions independently and impartially. During the exercise of functions, it ensures the equal and objective treatment of all persons without discrimination based on national, gender, race, political beliefs, religious belief and social position.

Independence and impartiality will be ensured by avoiding any kind of objectionable and illegal interference or obstruction in the work of the State Prosecutor.

The State Prosecutor will undertake the criminal prosecution against the perpetrators of criminal offenses who are prosecuted according to official duty or at the proposal of the victim, will supervise the work of the judicial police during the investigation of criminal offenses and lead the preliminary procedure during the collection of data and information necessary for the initiation of criminal proceedings.

During his work, the State Prosecutor evaluates and analyzes with equal dedication the incriminating and exculpatory evidence and during the investigation ensures that the investigation is carried out within the legal deadlines, fully respects the rights of the defendant and ensures the collection of evidence acceptable to the court.

Vision

The main goal of the State Prosecutor is the successful fight against crime in the Republic of Kosovo and the contribution to ensuring the rule of law.

The main priorities will be the successful prosecution of war crimes, organized crime, and criminal offenses that destroy the foundations of the country’s economy. Fighting these types of crime should be a challenge not only for the State Prosecutor, but also for all state bodies and the Kosovar society. For this purpose, it will cooperate with all law enforcement bodies, especially with the Kosovo Police, Kosovo Customs, Tax Administration and the Kosovo Anti-Corruption Agency.

The work of the State Prosecutor will be based on the respect of the Constitution of the Republic of Kosovo, international laws and conventions. Independence, impartiality, professionalism and basic human rights and freedoms will be respected during work.

Achieving public trust is a constant goal. For this purpose, the State Prosecutor will pay special attention to transparency and the media and civil society.
The utilization and rational use of the budget and human resources is also one of the important goals.
