Prishtinë, 23 January 2023 – The Prosecutorial Council of Kosovo (KPC) informs the public opinion that it has requested the Ombudsman to refer the Law on Salaries in the Public Sector to the Constitutional Court of the Republic of Kosovo in accordance with the statutory and legal provisions.
KPK has reflected in this request the continuous comments, which have been made in relation to this law.
KPK finds that with the entry into force of the Law on Salaries in the Public Sector, the independence and functioning of the prosecutorial system is violated due to the very fact that this matter was decided once with Judgment number KO 219/19 of the Constitutional Court of the Republic of Kosovo.
All claims raised by the KPC, which have been sent to the Ombudsman, in advance also to the drafters of this Law, are based on international acts and practices, which have foreseen when the salary of the state prosecutor can be deducted.
KPC expresses its full readiness to cooperate with the Ombudsman, with the aim of referring this law to the Constitutional Court of Kosovo.
KPC supports the drafting of a law on salaries in the public sector, which should be based on the best international practices and standards and which will not affect the independence and functioning of any power.
