Workshop on implementation of the Law on Disciplinary Responsibility of Judges and Prosecutors is held

Pristina, 8 November 2019 - The Chairman of the Kosovo Prosecutorial Council, Bahri Hyseni, along with Deputy Chairman Arben Ismajli, as well as members of the Prosecutorial Council, Chief Prosecutors of all prosecutions, prosecutors - members of investigative panels and the General Director of the Secretariat, have participated in a workshop on the implementation of the Law on the Disciplinary Responsibility of Judges and Prosecutors, organized by the US Embassy in Pristina, where also participated the KJC Chairperson, Judicial Council members, Presidents of Courts and judges - members of investigative panels. 

The purpose of this workshop was to discuss the interpretation of the provisions of the Law on the Disciplinary Liability of Judges and Prosecutors and its practical application and regulations, as well as to discuss the main challenges in disciplining judges and prosecutors. 

Initially, the Chairman of the Prosecutorial Council, Bahri Hyseni, presented a summary on the development of current disciplinary proceedings against prosecutors, stating that despite the dilemmas, the Prosecutorial Council has managed to establish 10 investigative panels since the entry into force of this law, where five hearings were held in the Council and relevant decisions were taken, while two more hearings are expected to be held at the next Council meeting.

On the other hand, representatives of the US Embassy in Pristina have said that the practical assessment of the implementation of the Law on Disciplinary Responsibility for Judges and Prosecutors is a result of the continuing demand to enhance the performance of the evaluation mechanisms of the justice system in Kosovo.

At the conclusion of this workshop it was unanimously requested that another roundtable of this nature be held, in which a joint group will be established to develop a practical guide to the implementation of this law, in order to have more clarity on the procedures for disciplinary responsibility of judges and prosecutors.
