Indictment for exercising influence
Prishtinë, March 4, 2020 – The Chief Prosecutor of the Special Prosecution Office of the Republic of Kosovo, Blerim Isufaj, has filed an indictment with the Basic Court in Prishtina - Special Department, against the two defendants with the initials R.I and B.G. for the offense of “Exercising influence” under article 424 par. 1 of the CCK.
The Special Prosecution informs that the defendant R.I. in the capacity judge of the Basic Court in Mitrovica, the General Department, branch Skenderaj, directly has received a material benefit by claiming that he is capable of exercising undue influence over the official's decision. Too the defendant on August 28, 2019, in the vehicle of the witness F.Z. while traveling together from Skenderaj to Prishtina, received money in the amount of 1.500.00€ (one thousand five hundred euro), in order for the defendant to exercise undue influence over the president of the Basic Court in Mitrovica, to decide on the postponement of the execution of the imprisonment sentence, final Judgment of the Basic Court in Mitrovica of date 26.07.2018 against witness F.Z. for a period of four (4) years and ten (10) months and exercising the same effect on the judges of the Supreme Court of Kosovo to undue the aforementioned judgment by extraordinary remedy, the request for protection of legality.
Herewith the defendant R.I. has committed criminal offense of “Exercising influence “ under article 424 par. 1 of CCK.
Also, the defendant B.G. in capacity Kosova police officer, directly has received a material benefit by claiming that he is capable of exercising undue influence over the official's decision, so on August 28, 2019, in the vehicle of the witness F.Z. in Fushe Kosova, received money in the amount of 1.000.00€ (one thousand euro), in order for the defendant to exercise undue influence over the judges of the Supreme Court of Kosova, to undue the judgment of Basic Court in Mitrovica, of date 26.07.2018, by extraordinary remedy, the request for protection of legality, by which judgment the witness was sentenced to imprisonment of four (4) years and ten (10) months.
Herewith the defendant B.G has committed criminal offense of “Exercising influence” under article 424 par. 1 of CCK.
