Gjilan Prosecution has filed indictment against M. Sh., H. Z. and V. K
Gjilan, 19th of May 2016 – Basic Prosecution in Gjilan, has filed indictment against three defendants M. Sh., H. Z. and V. K., charged for committing criminal offenses ‘Irresponsible medical treatment’, and ‘Failure to provide Medical Assistance’.
As per indictment, defendants M. Sh and H. Z., on 3rd of March 2016, in the Regional Hospital of Gjilan, in the ‘Maternity Ward’, when treating the patient, now deceased A. S., while providing birth medical assistance, due to negligence have used inappropriate medical equipment, by prescribing to the patient medical drugs that were not proper for her state.
Because of not providing proper treatment and actions by Doctors who should have provided the respective on time, there has come to the death of the patient, and thus, Doctors have committed criminal offense ‘Irresponsible medical treatment’, as stipulated by Article 260, paragraph 4 in conjunction with paragraph 1 of the CCRK.
As per indictment, the defendant V. K., on 2nd of March mars 2016, on the stand-by duty as a Doctor, in contradiction with her duties has refused and has not provided medical aid to the patient A.S, now deceased, before the birth delivery, although she has been aware that such negligence of not acting may result with health consequences for the health of the patient and her baby , thus committing criminal offense ‘Failure to provide medical assistance’, as stipulated by Article 261, paragraph 3 in conjunction with paragraph 1 of the CCRK.
