Detention on remand is required for the suspect for the criminal offense “Sexual assault”
Ferizaj, April 25, 2024 – The Basic Prosecution Office in Ferizaj, Department of Serious Crimes, announces to the public that it has requested from the Basic Court in Ferizaj, the appointment of the measure of detention on remand for a period of 30 days against the suspect with the initials Xh.I., due to the suspicion of the criminal offense “Sexual assault” under article 229 of the Criminal Code of the Republic of Kosovo.
According to the Prosecution Office, there is a well-founded suspicion that from April 2023 to April 24, 2024, at an unspecified time, in Shtime, for sexual purposes, he sexually abused the victim - a minor, who was under 16 years of age, with consent of her, in accordance with Article 225 of the CCRK, the term “consent” means the voluntary agreement of a person who has reached the age of 16, therefore, it is considered that the injured party did not give consent, in this way would be considered to have continued to commit the crime criminal “Sexual assault” under article 229 paragraph 5 related to paragraph 1 and related to article 77 of the CPRK.
The defendant, by decision of the State Prosecutor, since April 24, 2024, is under the measure of detention on remand for 48 hours for the aforementioned criminal offense.
