Persecution asks detention on remand against the suspect for committing the criminal offense “Abuse of Official Position or Authority”

Ferizaj, April 25, 2024 – The Basic Prosecution Office in Ferizaj, Department of Serious Crimes, announces to the public that it has filed a motion with the Basic Court in Ferizaj to impose the measure of detention on remand for a period of 30 days against the suspect with the initials B.XH., a former civil status officer in the municipality of Ferizaj, on suspicion of the criminal offense of “Abuse of Official Position or Authority” under Article 414 of the Criminal Code of the Republic of Kosovo.

According to the Prosecution Office, there is a suspicion that during March 2019 in Ferizaj, as a senior official in the Office of Civil Registry, B.XH, abused his official duties to benefit for another person. Specifically, contrary to Article 31 of the Law on Civil Registry number 04/L-003, B.XH., enabled the registration of the person M.K., a Turkish citizen, in the electronic Civil Status system in the Municipality of Ferizaj, enabling him to obtain an identity card of the Republic of Kosovo and a driver’s license. This action constitutes the criminal offense of “Abuse of Official Position or Authority” under Article 422, Paragraph 1, related to Article 31 of the KPRK.

The defendant has been under the measure of 48-hour detention for the aforementioned criminal offense since April 23, 2024, by decision of the State Prosecutor.
