Indictment against three persons for accepting and giving bribes
Gjilan, March 05, 2024 - The Basic Prosecution Office in Gjilan, Department for Serious Crimes, has filed an indictment against the defendant M.B., due to the criminal offense of “Accepting a bribe” and the defendants Sh.P. and N.O., for the criminal offense “Giving a bribe” of the Criminal Code of the Republic of Kosovo.
According to the indictment, the defendant M.B., while serving as the state prosecutor of the Basic Prosecution in Prizren, allegedly accepted an offer or promise of a €20,000 gift between April and July of 2023 in Prizren. This purportedly occurred during a representation at the Basic Court in Prizren on March 31, 2023. The offer was allegedly made in exchange for a promise to waive criminal prosecution in the absence of evidence against the accused individuals N.O., U.S., and A.S. for the criminal offense of "Unauthorized purchase, possession, distribution, and sale of narcotics, psychotropic, and analogous substances" under the Criminal Code of the Republic of Kosovo (CCRK).
These actions, as described, are said to constitute the criminal offense of "Accepting a bribe" under Article 421, Paragraph 1 of the CCRK.
The defendants Sh.P. and N.O. allegedly promised to give a bribe directly to the other person, now identified as the defendant M.B. This promise was made with the intention that M.B., acting in capacity of the state prosecutor, would, at the conclusion of the main trial on March 31, 2023, waive the indictment against the accused individuals N.O., U.S., and A.S. for the aforementioned criminal offense.
These actions, as described, are said to constitute the criminal offense of "Giving a bribe" under Article 422, Paragraph 1, related to Article 31 of the Kosovo Penal Code (KPRK).
