Speech of Chief State Prosecutor, Aleksandër Lumezi, at the inauguration ceremony of the premises of the Basic Prosecution in Ferizaj

Prishtina, 10th of February 2016 – We are here together in this important event for the Prosecution Institution, and that is inauguration ceremony of the new premises of the BP in Ferizaj. Therefore, on behalf of the State Prosecutor I would like to greet and thank you for your participation in this ceremony, in particular Prime-minister of the Republic of Kosova, Mr Isa Mustafa, Ambassador of USA Mr Greg Dellawie, EULEX Mission Representative Mr Peter Bach, Mayor of Ferizaj Municipality Mr Muharrem Sfarqa,  Prosecutors, Judges, and all of you present,

Today, BP in Ferizaj will start working in this new building, in which Prosecutors and supporting staff shall exercise their daily duties. Upon the building of these premises and fulfilment of vacant positions for new Prosecutors, there will be in place better working conditions that will enable BP in Ferizaj to start fulfilling in a stronger manner, its responsibility in the fight against negative phenomena which State of Kosova is encountering in the area of Rule of Law, such as corruption, terrorism, organized crime and other numerous criminal offenses jeopardizing life, wealth, property, safety and peace of our citizens.

The fact that until now were built new premises for the needs of BPs, such as the one of the BP in Prishtina, BP in Gjilan, BP in Prizren, BP in Peja, BP in Ferizaj, and since the building of the premises of the BP in Gjakova is in process, gives us the right to believe that executive branch is engaged in improvement of work conditions for the State Prosecutor. All of you that will exercise the activities in this facility financed by the budget of Kosova shall be aware that you have a very important duty, and you shall be aware of your role in the society.



State Prosecutors shall demonstrate their decisiveness in executing their constitutional and legal obligations against those abusing with the wealth of the State, those jeopardizing Human Rights and social values guaranteed and protected with the Constitution of our country and International Law.

I expect from all of you, State Prosecutors and supporting staff of this Prosecution, to serve citizens of Ferizaj with dedication whenever they knock on the doors of this Prosecution; and I also expect from you to raise the level of communication with citizens, because they are the best evaluators and the ones that measure your independence and integrity.

Thus, I invite all harmed ones from crime, and all those wishing to assist justice, to become significant part of the Prosecutors` work, so the latter will be able to do their best in detection and crime punishment.

State Prosecutor is facing with numerous challenges related to consolidation of the State in which Rule of Law is present, therefore, you shall comprehend that fighting crime and bringing perpetrators before Justice, is not a burden that only one Institution shall carry. I am saying this, since having Rule of Law and Order in place, implies that other Institutions shall also execute their duties, and shall not allow avoidance of justice by the convicted.

State in which Rule of Law is present, in no way can be built if the legal provisions are ignored, by giving priority to personal and party interests. In this regard, I would like to say that Constitution, Law and Institutions are not provisional establishment, but the respective are foundations of the new State of Kosova, which will belong to lots of other generations as well.

In Kosova, just as in lots of other democratic countries as well, Justice system shall remain the mechanism in charge of regulating conflicts in the society. The history of human society has shown that the success of a State does not lie outside Institutional debates, neither in the personal rhetoric and personal stances which may only lead to aggravation of political tensions and their deterioration. On the contrary, dialogue and compromise, mediation and communication are part of the democratic vision, which also reflects the strengthening or fragility of the justice system.

Ladies and Gentlemen,

Few days ago you may have heard unpleasant words regarding the performance of State Prosecutors and in some cases threats by those paid to protect crime and who also know to speak on behalf of justice. We will never allow denigration of our work from fake accusations against us, we shall neither be intimidated by the threats for our destroying; we are State servants and we shall believe that Justice brings power, and upon this trust we will be courageous to exercise our duty until the end, just as allowed by Law.  
You, State Prosecutors, shall carry on treating all criminal offenses suspects with honour and fairness, regardless their name and social positions, and if, eventually, you deliver a request without any facts, and the same is made clear to you, you shall be ready to treat with pleasure restoring of the justice.

We shall carry on giving our contribution in Justice accomplishment, by respecting Court Verdicts; whereas, when not agreeing with those, they shall be commented and contested through the right to appeal, and requesting the inquiry of the respective cases in a higher instance.


I do not want to believe that some Court Verdicts are issued following arithmetical calculations, and honestly, I feel sorry in this regard, since those Verdicts can damage Justice and bring in place loss of trust by citizens. Whenever we are dissatisfied with the Court Verdicts, we shall pursue the institutional path, but in some certain cases when we possess facts that Court Verdicts were issued unlawfully by harming rights of other persons, we shall act in accordance with our Constitutional and legal rights.

State Prosecutor, through good work results, is increasingly receiving support from society, State Institutions, and support from International partners as well. We shall appraise this support, and we shall demonstrate our readiness to take over all the competencies in the area of the Rule of Law, and we shall abandon daily rhetoric, and embrace concrete actions for convincing everyone that we are determined to establish a fair justice system for all citizens of our country.

All of us shall contribute in building Rule of Law, building a more effective and professional justice system, in which citizens have trust, and this is significant for our country and European Integration process.

Lastly, to all Prosecutors, Legal Associates and administrative staff, I wish a successful and fruitful work in the new premises, and from all of you I request to have good cooperation and coordination with Kosovo Police, Courts and other Law Enforcement Authorities; to be decisive and stoic in investigation of crimes, in representation of indictments before the Court, as well as respecting rights of all parties facing with Justice inside the doors of this new building.
