The Kosovo Prosecutorial Council reacts to the decision of the Government of Kosovo for the approval of the new Draft Law for the KPC

Prishtinë, 13 July 2023 – The Kosovo Prosecutorial Council (KPC) reacts to the decision of the Government of the Republic of Kosovo to approve the new Draft Law for the Kosovo Prosecutorial Council, at the meeting held yesterday, July 12, 2022, calling it a new attempt to infringe on his independence.

Also, the KPC, on this occasion, emphasizes that the adoption of the new Law on the KPC is a continuation of the unilateral process of the Government of Kosovo, which at the same time undermines our cooperation for the reform process, expressed through the signing of the Joint Declaration of Commitment from our relevant justice institutions.

The Kosovo Prosecutorial Council declares that against what the Constitutional Court has declared invalid the Law on the Kosovo Prosecutorial Council, after the request for evaluation of its constitutionality, The Government of Kosovo has not been satisfied with the verdict of the highest constitutional body in the country and has continued with complete non-coordination and hastily and unilaterally approved this very important Draft Law, completely disregarding the Strategy for the Rule of Law and the process of reform in justice and completely ignoring the necessary coordination with the prosecution system and local and international partners.

The KPC declares with conviction that the prosecutorial system has supported the initiated reform, including the legal changes for which the will of joint commitment has been expressed, but this legal initiative had to be realized at the right time, therefore any return of initiatives and decisions of this type, without respecting the separation of powers and without mutual coordination, as has happened in the past and as is happening now on the part of the Government of Kosovo, is a big step back and brings failure, therefore the KPC warns that it will pursue all legal and constitutional avenues to contest the content of the new Law of the KPC, since it violates the constitutional mandate and the independence of the prosecutorial system, as well as bypassing international standards, making it impossible to operationalize and making it easily influenced by politics.

The Prosecution Council of Kosovo declares that it remains committed to supporting the general reform processes and is committed to cooperate with all local and international partners in any initiative aimed at the necessary reform, in order to strengthen the rule of the law in Kosovo and the prosecutorial system of Kosovo to do its independent, professional, transparent work.
