STATEMENT OF THE KOSOVO PROSECUTORIAL COUNCIL

Prishtinë, 23 June 2022 – Kosovo Prosecutorial Council (KPC), through this statement, expresses concern regarding the passage in the second reading of the Law on KPC in the Assembly of Kosovo.

As it is known, the Prosecutorial Council, since the beginning of the process of drafting the KPC Draft Law, as provided by the Rule of Law Strategy, has given its contribution to the working groups of the Ministry of Justice and the Assembly of Kosovo, where came up with concrete proposals, which have never been considered by the Ministry of Justice, respectively, by the relevant committee of the Assembly of Kosovo.

KPC considers that the voting of this law, in this way, seriously violates the independence of this constitutional body.

Moreover, the content of this law will disable the functioning of the prosecutorial system and will make it easily influenced by politics.  

As this Law violates the constitutional mandate of the members of the Council, the Council announces that in addition to pursuing all legal avenues to challenge the content of this law, also no member of the Council will be subject to the unconstitutional and illegal requirements that are also against international standards, but also against two recommendations given by the Venice Commission.
