Detention on remand is requested against two persons for “Abusing official duty or Authority”, “Accepting and giving bribes” and “Smuggling of goods”
Ferizaj, May 20, 2021 - The Basic Prosecution in Ferizaj, Department for Serious Crimes, has submitted a request for detention on remand before the Basic Court in Ferizaj, against two (2) persons, defendant B.K., customs officer in Hani i Elezit and L.S., pharmacy technician, who are in detention from 18 May 2021, due to grounded suspicion of the criminal offenses “Abusing official position or authority”, “Accepting Bribes”, “Smuggling of goods” and “Giving bribes”.
According to the request of the Prosecution, there is a grounded suspicion that the defendant B.K., from October 2020 to 18 May 2021, at the border crossing in Hani i Elezit, in the capacity of an official person as a customs officer at the Kosovo Customs, in order to obtain unlawful material benefit for himself or another person - the defendant L.S., intentionally fails to fulfill his official duties, in such a way that while in office, he notifies the defendant L.S., of the time he is assigned to the Line track for vehicles customs clearance and citizens control while crossing the border, which enables the defendant to cross the border by smuggling goods through northern Macedonia to the Republic of Kosovo without being subjected at all to the legal control procedures with which he has committed the criminal offense “Abuse of official position or authority” under Article 414 paragraph 3 subparagraph 3.1 in conjunction with paragraph 1 of the Criminal Code of the Republic of Kosovo (CCRK).
The same, on 18 May 2021, at around 17:20 hrs., at the border crossing point in Hani i Elezit, in the capacity of an official person as a customs official at the Kosovo Customs, with intent to obtain unlawful material benefit by acting contrary to his official duties, directly requests and accepts bribes from the defendant L.S., so that from the same when crossing the border he receives the total amount of money of € 70, thus enabling him to cross the border point without being subject to legal procedures of control, with which he committed the criminal offense “Accepting bribes” under Article 421 paragraph 2 of the CCRK.
While, the other defendant L.S., from October 2020 until May 18, 2021, at around 17:20 hrs., at the border point in Hani i Elezit, with intent to unlawfully obtain material benefit for himself, carried goods and crossed the line avoiding customs control, in such a way that when being stopped and cleared by customs investigators, in the vehicle of the defendant "Nissan Pulsar", they found and seized a quantity of drugs consisted of 15 items, respectively one thousand three hundred eighty-five (1,385) packages as well as two hundred and forty-eight (248) pieces, while during the control of the warehouse, property of the defendant, a quantity of three hundred and fifty-nine (359) items of drugs was found and seized, a total of sixteen thousand two hundred and ninety (16,290.00) packages, with which he committed the criminal offense “Smuggling of Goods”, under Article 311 paragraph 1 of the CCRK.
Also, the same person on May 18, 2021, at around 17:20, at the border point in Hani i Elezit, with intent to obtain unlawful material benefit for himself, he directly offers an unreasonable gift or other benefit to the official person, respectively customs official B.K., in this way acted contrary to his official duties, by giving him the amount of money of € 70, for which they had agreed in advance by phone, in order to avoid procedures of border customs clearance, with which he committed the criminal offense “ Giving Bribes” under Article 422 paragraph 2 of the CCRK.
