Detention on remand is required against eight persons for the criminal offenses “Abuse of official position or authority”, “Bribery” and “Unauthorized possession, control or possession of weapons”.
Ferizaj, April 16, 2021 - The Basic Prosecution in Ferizaj, Department for Serious Crimes, has submitted a request for detention on remand in the Basic Court in Ferizaj, against eight (8) defendants with the initials N.A., B.B., H.B., S.M., R.U., A.A., A.B., and B.Q. - from the municipality of Ferizaj, who are held in detention from 15 April 2021, due to grounded suspicion of criminal offenses “Abuse of official position or authority” under Article 414, “Bribery” under Article 421, and “Unauthorized ownership, control or possession of weapons ” under Article 366 of the Criminal Code of the Republic of Kosovo (CCRK).
According to the request of the Prosecution, there is a grounded suspicion that during 2020, in the territory of the Municipality of Ferizaj, the defendants in the capacity of official persons as forest guards and forestry technicians of the Directorate of Agriculture and Forestry in the Municipality of Ferizaj, took advantage of their official position in order to obtain the illegal material benefit for themselves and for other persons, intentionally did not perform their necessary duties defined by law, respectively acted in violation of Article 7 of Administrative Instruction number 05/2010 on the Protection of Forests, the responsibilities and obligations of the forest guard, in such a way that despite the fact that they are obliged that at the moment when they encounter forest intruders illegally cutting wood, to issue a report to them, the same did not they do such a thing instead they reach an agreement with them and as a consideration for not filing the offense report, they accept different amounts of money causing damage to the budget of the Republic of Kosovo, respectively the Directorate of Agriculture and Forestry in the Municipality of Ferizaj, with which each of them separately have committed the criminal offense "Abuse of official position or authority” under Article 414 paragraph 3 subparagraph 3.2 with paragraph 1 of the CCRK.
