Reaction by Kosovo Prosecutorial Council
Prishtina, 18th of November 2016 - “Kosovo Law Institute (KLI) has recently published a report titled “Lawlessness of Kosovo Judicial Council and Kosovo Prosecutorial Council.”
Upon this publishing the author claims that mandate of KPC member, Mr Idain Smailji has expired and he shall not be part of the Council.
Taking into account that those are serious claims and that the legitimacy of the Council`s composition is set in doubt, we have seen it as reasonable to inquire this matter. Following the inquiry of the official minutes of meetings and documents related to the mandate of the KPC member, Mr Idain Smailji, we strongly believe that his mandate did not expire.
Although we respect the significant role of civil society in monitoring Prosecutors and Judges, we do not always agree with their conclusions. In this case we strongly do not agree with the author of this report. KPC member, Mr Idain Smailji has served in lawful mandate and he shall carry on being in the respective position until its expiry.
