The Special Prosecution of the Republic of Kosovo has filed an indictment against three defendants for War Crimes against the Civilian Population

Pristina, December 30, 2024 – The Special Prosecution of the Republic of Kosovo has filed an indictment with a proposal for trial in absentia, at the Basic Court in Pristina – Special Department, against the defendants D.G., Ž.C. and Z.Š.

For the defendant D.G. there is a well-founded suspicion that in his capacity as an official – rank of Colonel – Head of the Secretariat of Internal Affairs in Gjilan, in the period January-July 1999, superior and supervisor of all his subordinates and with effective control over them and the territory of the Municipality of Gjilan, during the war in Kosovo, he was aware or should have been aware and did not take any action to prevent, stop or report to the hierarchy regarding the killings, injuries, burning alive of Albanian civilian victims, taking hostages, beatings, mistreatment, physical and psychological torture, looting, expulsion of the Albanian civilian population, in the villages of Inatoc (Kokaj), Llovce, Pogragje and Uglar, these actions sanctioned according to local laws, customs of war and the International Geneva Conventions and Additional Protocols, therefore, – with this, he committed the criminal offense, War Crimes Against the Population Civil from Article 142 of the Criminal Code of the SFRY.

For the defendant Ž.C. there is a well-founded suspicion that during the war in Kosovo, specifically in the Gjilan region, as part of a criminal group, in co-perpetration with D.C., D.N., M.SH., N.S. and S.J., as well as other unidentified members of this group, armed and dressed in camouflaged uniforms and irregular uniforms of the Serbian police or army, they participated in the murder of eight (8) Albanian civilians, and specifically two of these victims were placed in a pile of wood, where one of them was burned alive, they had beaten, mistreated, tortured, robbed, and expelled the Albanian civilian population, these actions sanctioned according to local laws, customs of war and the International Geneva Conventions and Additional Protocols, therefore, with this, in co-perpetration, they committed the criminal offense of War Crimes Against the Civilian Population under Article 142 in conjunction with article 22 of the Criminal Code of

Meanwhile, for the defendant Ž.S. there is a well-founded suspicion that in his capacity as a doctor of the Regional Hospital in Gjilan, on 05/04/1999, he did not provide proper medical assistance to the victim N.R., who was injured by the criminal group as above, only because the same was of Albanian nationality, he ordered the same to leave the Hospital as soon as possible, and as a result of this action the victim died in the late hours of the same day, – with this, he committed the criminal offense, War Crimes Against the Civilian Population from article 142 of the Criminal Code of the RSFY.
