Indictment for possession and sale of narcotics
Prizren, May 26, 2020 - The Basic Prosecution in Prizren, Department of Serious Crimes, has filed an indictment against the defendants with the initials A.K., A.S., and R.B., due to reasonable suspicion that they have committed the criminal offenses “Unauthorized purchase, possession, distribution and sale of narcotics, psychotropic and analogous substances” under Article 267 paragraph 2 and “Unauthorized possession of narcotics, psychotropic and analogous substances ” under Article 269 paragraph 2-1 of the Criminal Code of the Republic of Kosovo (CCRK).
According to the indictment, the first accused A.K., on 01.03.2020 at around 18:30 in Prizren, without authorization distributed psychotropic substances of the type “marijuana” which were declared by law as narcotics in such a way that in the parking lot of Jumbo- s “near the vehicle” BMW 316 I“ distributed and sold psychotropic plants of the type “marijuana” for consumption of the accused A.S., and R.B., so that after being noticed by the police, they throw a plastic bag onto the ground with a narcotic substance weighing 0.85gr and a cigarette wrapped in marijuana weighing 1.02gr.
Meanwhile, after checking the vehicle and raiding the house of the accused A.K., a package of rizla rolling paper with the inscription OCB SLIM, a gray color grinder, and a narcotic substance weighing 53.3 gr were found as well as cash 1x20 euros, 1x10 euros, 10x5 euros total 80 euros.
With these acts, the accused A.K., has fulfilled the elements of the criminal offense “Unauthorized purchase, possession, distribution and sale of narcotics, psychotropic substances and analogues” under the CCRK.
Whereas, the second accused person, A.S., and the third accused person R.B., at the same time and place, without authorization, possessed psychotropic substance of the type “marijuana” in such a way that from the first accused A.K., they receive a 1.2 gr cigarette as well as an amount of 0.8 gr. of the type “marijuana” and at the parking lot of “Jumbo” near the vehicle "BMW 316 I" both together consume psychotropic plants of the type “marijuana”, but the same after being noticed by the police, throw the cigarette and the amount of marijuana on the ground.
With these actions, the accused A.S., and the accused R.B., each separately have met the elements of the criminal offense “Unauthorized possession of narcotics, psychotropic substances and analogues” under CCRK.
The prosecutor of the case, upon having filed the indictment, proposed to the Court to find the accused person guilty and sentence him under the law, for the criminal offenses as charged.
