33 persons indicted for “Abusing official position or authority” "Taking bribes", "Smuggling of goods" and "Unauthorized control or possession of weapons"
Prishtinë, May 18, 2020 - The Special Prosecution of the Republic of Kosovo, has filed indictment by the Prishtina Basic Court- Special Department, against thirty- three (33) persons : Z.S., B.N., A.H., A.M., M.M., O.K., R.M., D.S., D.K., J.S., Z.B., B.M., A.P., Z.R., K.S., R.K., V.T., B.T., L.V., B.M., B.L., N.G., I.J., J.M., M.J., N.B., N.J., S.I., Xh.J., A.I., B.U., B.M. and F.I., on charges “Abusing official position or authority” "Taking bribes", "Smuggling of goods" and "Unauthorized control or possession of weapons".
The Special prosecution informs that the defendants Z.S., B.N., M.M., A.M and A.H., since 2017 until May 2019, continuously, in co-perpetration with the defendant D.V, who is at large, in the capacity of official persons, using his official duty or authority, intentionally did not perform the duties defined by law and did not fulfill their official duties with intention to benefit for themselves or to another person.
The above-mentioned have abused their official duty and authorizations by allowing and enabling the smuggling of various goods such as animals, fuel, alcoholic and non-alcoholic beverages, and foodstuffs from Serbia to the Republic of Kosovo and vice versa, through illegal routes, while in official duty have supervised the roads of the border , in this manner they have enabled illegal benefit of the defendants D.I, B.R, D.D, M.R, M.R, Z.V and other persons as carriers of goods avoiding customs control and customs duties when importing of goods, in which case they have caused significant material damage to the budget of the Republic of Kosovo. With these actions, the defendants, continuously and in co-perpetration have committed the criminal offenses, “Abusing official position or authority” under article 422 par. 1 in connection with par. 2 subpar. 2.2 and articles 81 and 31 of the CCRK.
Also, the defendants in the same period of time, continuously and in co-perpetration in the capacity of official persons in order to benefit illegal property, have received – accepted money, in such way that they as official persons to act or not in contrary to their official duty, so that the defendants D.I, B.R, D.D, M.R, M.R, Z.V and other persons as carriers of goods, that vehicles with goods pass by avoiding customs control and customs duties when importing goods, they have accepted - received various amounts of money to act contrary to their official duty. With these actions, the defendants continuously and in co-perpetration have committed the criminal offenses "Taking a Bribe" from article 428 par. 2 in connection with article 81 and 31 of the CCRK.
The defendants O.K., R.M., D.S., D.K., J.D., Z.B., B.M and A.P. since 2017 until May 2019, continuously and in co-perpetration, in the capacity of official persons, using their official duty or authority, intentionally did not perform the duties defined by law and did not fulfill their official duties in order to benefit for themselves or for the others , in such a way that the defendant O.K in the capacity of shift leader and the defendants R.M, D.S, D.K, J.D, Z.B, B.M, B.M, A.P, in the capacity of patrol officers within the shift "B", of SPMK in Zubin Potok, have abused their official duty and authorizations allowing and enabling the smuggling of various goods such as animals, derivatives, alcoholic and non-alcoholic beverages and foodstuffs from Serbia to the Republic of Kosovo and vice versa, thus enabling the illegal property gain of defendants D.I, B.R, D.D, M.R , M.R, Z.V and other persons as carriers of goods, avoiding customs control and customs duties when importing goods. With these actions, the defendants in co-perpetrators have committed the criminal offense "Abuse of official position or authority" under article 422 paragraph 1 in conjunction with paragraph 2 subparagraph 2.2 and articles 81 and 31 of the CCRK.
From 2017 to May 2019, continuously, the defendants in co-perpetration in the capacity of official persons for the purpose of illegal property gain, have received – accepted money, in manner that they as officials to act or not, contrary to their official duty, so that the defendants D.I, B.R, D.D, M.R, M.R, Z.V and other persons as carriers of goods, that vehicles with goods pass by avoiding customs control and customs duties when importing goods , have accepted - received different amounts of money to act contrary to their official duty. With these actions, the defendants have committed the criminal offense "Taking bribes" under article 428 par. 2 in connection with article 81 and 31 of the CCRK.
The defendants Z.R., K.S., R.K., V.T., B.T., L.V., B.M., and B.L. from 2017 to May 2019, continuously and in co-perpetration, in the capacity of official persons, using the official duty or authority, intentionally did not perform the duties defined by law and did not fulfill their official duties in order to gain any benefit for themselves or for the others in such a way that the defendant Z.R, in the capacity of the shift leader, and the defendants K.S, R.K, V.T, B.T, L.V, B.M, B.L, in the capacity of patrol officers within the “C” shift, of the SPMK station, have abused their official duty and authorizations by allowing and enabling the smuggling of various goods such as animals, fuel, alcoholic and non-alcoholic beverages and foodstuffs from Serbia to the Republic of Kosovo and vice versa, enabling the unlawful property gain to the defendants D.I, B.R, D.D, M.R, M.R, Z.V and other persons as carriers of goods avoiding customs control and customs duties when importing goods. With these actions, the defendants, in continuation and co-perpetration, have committed the criminal offense, "Abusing official position or authority" under article 422 par. 1 in connection with par. 2 subpar. 2.2 with articles 81 and 31 of the CCRK.
From 2017 to May 2019, continuously, the defendants in the capacity of official persons, in co-perpetration, for the purpose of illegal property gain, have received – accepted money, in such a way that as official persons to act or not, contrary to their official duty, so that the defendants D.I, B.R, D.D, M.R, M.R, Z.V and other persons as carriers of goods, that vehicles with goods pass by avoiding customs control and customs duties when importing goods , have accepted - received different amounts of money acting contrary to their official duty . With these actions, the defendants in continuation and co-perpetration have committed the criminal offense, "Taking Bribes" under article 428 par. 2 in connection with articles 81 and 31 of the CCRK.
The defendant N.G, from 2017 to May 2019, in the capacity of official person, continuously, using official duty or authority, intentionally did not perform the duties prescribed by law and did not fulfill his official duty in order to gain any benefit for himself or for another person in such a way that the defendant N.G, in his capacity as the shift leader, within the shift “D” of the SPMK station in Zubin Potok, has abused his official duty and authorizations by allowing and enabling the smuggling of various goods such as animals, fuel, alcoholic and non-alcoholic beverages and foodstuffs from Serbia to the Republic of Kosovo and vice versa, thus enabling the illegal property gain to the defendants D.I, B.R, D.D, M.R, M.R, Z.V and other persons as carriers of goods avoiding customs control and customs duties when importing goods. With these ongoing actions he has committed the criminal offense “Abusing official position or authority” under article 422 par. 1 in connection with par. 2 subpar. 2.2 and Article 81 of the CCRK.
From 2017 to May 2019, the defendant in the capacity of an official person, continuously, for the purpose of illegal property gain, has received money, in such a way that he as an official person acting or not, contrary to his official duty, so that from the defendants D.I, B.R, D.D, M.R, M.R, Z.V and other persons as carriers of goods that vehicles with goods pass by avoiding customs control and customs duties when importing goods , has accepted - received various amounts of money acting contrary to his official duty. With these ongoing actions he has committed the criminal offense, and "Taking bribes" under article 428 par. 2 in connection with article 81 of the CCRK.
The defendants I.J., A.I., F.I., B.U., N.J., Xh.J., M.J., N.B., B.M., J.M. and S.I., from 2017 to May 2019, continuously and in co-perpetration also with defendants D.I. and B.R, who are at large, for the purpose of illegal material gain have smuggled animals from the Republic of Serbia to the Republic of Kosovo, avoiding customs control and customs duties when importing goods, in manner that the defendants M.J, N.B , B.M, J.M, S.I, have traveled to Serbia where they bought the animals, then the same animals according to the agreement were handed over to the defendants D.I and B.R, who have smuggled the animals illegally across the border, by cooperating with the defendants in the capacity of official persons in the Kosovo Police in SPMK-Zubin Potok. Then the defendants I.J, A.I, F.I, B.U, N.J, Xh.J, take the animals from the farms (stables) of the defendants D.I, B.R and hand them over to their owners as in the villages Pasomë and Akrashtica of the municipality of Vushtrri and the village of Sankovc in the municipality of Drenas.
With these actions, the defendants in co-perpetration and in continuation have committed the criminal offenses "Smuggling of goods" under article 317 par. 1 in connection with articles 81 and 31 of the CCRK.
On 28th of May 2019, in the village of Kushtovë, Mitrovica municipality, during the search ordered by the Kosovo Police, an AK-47 firearm with serial number A-33013, an M-48 rifle with serial no. 61075, 12 automatic rifle cartridges, 30 M-48 rifle cartridges, a continuous part of the automatic rifle have been found, possessed without the relevant authorization and permission and contrary to the applicable law regarding weapons. With these actions, the defendant has committed the criminal offense "Unauthorized possession and control of weapons" under article 374 par. 1 of the CCRK.
Also, on 28th of May 2019, in the village of Koshtovë, Mitrovica municipality, during the search ordered by the Kosovo Police, a hunting rifle of the type “Zastava” with serial number 19247 and two cartridges of caliber 12 mm, were found and confiscated from the defendant, possessed without the relevant authorization and permission and contrary to the applicable law regarding weapons. With these actions, the defendant has committed the criminal offense "Unauthorized possession and control of weapons" under article 374 par. 1 of the CCRK.
