INDICTMENT AGAINST FIVE PEOPLE FOR THE PREPARATION OF TERRORIST OFFENSES OR CRIMINAL OFFENSES AGAINST THE CONSTITUTIONAL ORDER
Prishtinë, 23 December 2022 – The Special Prosecution Office of the Republic of Kosovo (SPRK) has filed an indictment in the Basic Court in Prishtinë - Special Department, against five (5) defendants with the initials A.Gj., E.S., N.S., M.B and Sh.K, for various crimes criminal.
The defendants, A.Gj., E.S., N.S dh M.B., during the time period from March 2021 to 10.10.2021, initially tried to create an organizational structure for committing terrorist acts in Kosovo, by contacting a high-ranking person of the terrorist organization ISIS - Foreign Relations Office, have engaged in the provision of various types of weaponry. With these actions, the aforementioned defendants have committed the criminal offense "Preparation of terrorist offenses or criminal offenses against the constitutional order and security of the Republic of Kosovo", from article 138 par. 1 related to the criminal offense "Committing a terrorist offense" from article 129 paragraph 1 related to article 31 of the CCRK.
Meanwhile, the defendants E.S. and A.Gj., without authorization, secured and kept under control by hiding and burying in well-insulated plastic bags an arsenal of firearms and ammunition of various types. With these actions, the aforementioned defendants have committed the criminal offense "Unauthorized ownership, control or possession of weapons" from article 366 paragraph 2 in relation to paragraph 1 of article 31 of the CCRK.
The defendant A.Gj. is accused of the criminal offense of "Failure to notify the preparation of criminal offenses" from article 377 paragraph 2 under paragraph 2.1 and 2.4 related to paragraph 1 of the CCRK, because he, from October 2020 until 02.11.2022 was aware that the defendant (now deceased) K.F. was preparing terrorist acts in Vienna, Austria.
The defendant N.S. is charged with the criminal offense of "Facilitating and financing the commission of terrorism" article 131 paragraph 1 of the KPRK, because on 07.10.2021, on the Prizren-Suharekë, highway, on the street "Ukë Bytyqi" in person has delivered the sum of two thousand (2000) euros to the defendant Sh.K. in the name of purchasing firearms.
The defendant M.B. is accused of having committed the criminal offense of "Unauthorized ownership, control or possession of weapons" from article 366 paragraph 2 of the KPRK, because at the previously unproven time without authorization in his house in Prizren has secured and kept in ownership a considerable amount - arsenal of weapons of various types.
The defendant, Sh.K., is accused of having committed the criminal offense "Unauthorized import, export, supply, transportation, production, exchange, brokering or sale of weapons or explosives" from article 364 paragraph 2 of the Criminal Code, because on 10.10.2021, in violation of the applicable Law regarding weapons or explosive materials, he provided firearms of various types for the purpose of extortion, as well as received the sum of two thousand (2000) euros.
