Chief State Prosecutor Lumezi participated in the roundtable “Separation of Powers and Independence of the Judiciary”

Prishtina, January 25, 2022 - The Chief State Prosecutor, Aleksandër Lumezi, participated in the fifth roundtable of the Steering Committee of the European Union Program for the Justice Sector in Kosovo “EUKOJUST”, where the purpose of this roundtable was to present the Report on the Separation of powers and Independence of the Judiciary.

In his speech before the audience, Chief State Prosecutor Lumezi, emphasized the separation of powers, respect for the independence of the Judiciary and inter-institutional cooperation within the responsibilities and competencies defined by the Constitution and applicable laws.

Speaking about institutional independence, the Chief State Prosecutor stressed that the separation of powers is not a coincidence and that this separation should be respected by all.

“It is no coincidence that we are an independent constitutional mechanism. We do our job. Regardless of whether someone else likes it or not. But it is vital for a democratic state and for a democratic society that the separation of powers not only appear as a constitutional guarantee on paper, but that this is guaranteed in practice and fully respected.” The activity of the bodies of the judiciary cannot be controlled by the bodies of another power", emphasized, among others, the Chief State Prosecutor Lumezi.

The Chief State Prosecutor stated that even within the justice system there are things that need to be improved, but their addressing should be done only by independent constitutional institutions, respectively by the judiciary and not by other powers.

 “I do not claim that we have no mistakes. However, the mistakes we have should be addressed only by independent constitutional institutions, respectively by the judiciary. Therefore, the Executive and the Legislature can improve our work, helping us with budget support, passing laws and respecting the independence we have, as well as by strengthening mechanisms within the system itself to address the problems and omissions encountered so far” said the Chief State Prosecutor, Lumezi.

In the end, the Chief State Prosecutor expressed his readiness to increase cooperation and coordination with other institutions, but only within the framework of non-interference in each other’s affairs and respecting institutional and constitutional independence.
