20923 criminal reports - cases completed by the State Prosecutor during the period January - June 2020

Prishtina, October 9, 2020 - In order to provide information and data as detailed and comprehensive as possible on the work, achievements, challenges and general activities, the State Prosecutor has compiled the work report for the period January - June 2020.

Despite the fact that dealing with the Covid-19 pandemic has been challenging for the organization of work and human resources, during the first half of this year, the State Prosecutor has achieved a good performance in carrying out prosecutorial functions in fulfilling the constitutional and legal mandate.

In the period between January - June 2020, the State Prosecutor received at work 20,032 criminal reports-cases, while has managed to complete 20,923 criminal reports-cases, or 891 criminal cases, or 4.44% more than he received at work during the reporting period.

Based on the indicators of the European Commission for the Efficiency of Justice (CEPEJ), the rate of completed cases in relation to the number of cases received during this period, results that the completed rate of cases by the State Prosecutor is 104.44%.

If we compare the work by departments, the Departments of Serious Crimes (SCD) of the Basic Prosecution Offices have completed 231 or 10.97% of criminal reports - cases more than they have received at work; juvenile departments (JD) have completed 134 or 17.29% less criminal reports than they received at work, while general departments (GD) have completed 801 or 5.84% more criminal reports than they have received at work.

In addition, the State Prosecutor has paid attention to alternative procedures, where with known perpetrators he has completed 670 cases with 772 persons. Whereas, during the first half of 2020, 750 cases were completed with a punitive order.

Regarding cases of corruption and economic crime, the State Prosecutor in the first half of 2020 has received 297 cases with 502 persons for corruption cases, while has completed 279 cases or 93.93%, with 580 persons or 115.53% of persons. On the other hand, for economic crime cases, 225 cases with 370 persons were received, while 248 cases or 110.22% were completed, with 326 persons or 88.10% of persons.

Meanwhile, for the criminal offenses of organized crime, the State Prosecutor during the period January - June 2020 had 38 cases at work with 211 persons, of which 4 are new cases received to work with 34 persons. Out of these, 4 cases with 23 persons have been completed, while 34 cases with 181 persons have remained uncompleted. During this period, regarding the indictments filed by the State Prosecutor, courts have decided cases for 7 persons, all completed with condemnatory judgments.

The State Prosecutor has also treated with priority the cases of trafficking in human beings, where during the first half of 2020, 96 cases with 177 persons were at work with major perpetrators. Out of these, 9 cases with 16 persons were completed, while 87 cases with 161 persons remained uncompleted.

Regarding cases of domestic violence, during the reporting period, there were 1662 cases with 1968 persons with adult perpetrators at work, of which 857 cases are new cases received to work with 1006 persons. Out of these, the State Prosecutor has completed 699 cases with 827 persons, while 963 cases with 1141 persons remain uncompleted.

With the indictment and the proposal for imposing compulsory treatment measures, the State Prosecutor has completed 81% of the persons. Regarding the indictments filed by the State Prosecutor, during this period, courts have completed cases for 302 persons, of which 298 are guilty decisions, respectively measures of compulsory treatment.

The Office for Protection and Assistance to Victims, which operates within the Office of the Chief State Prosecutor, has also provided services and assistance to victims of crime, resolving 803 cases of domestic violence, harassment and sexual assault, and trafficking in human beings, rape, prostitution and other cases. Judicial decisions regarding indictments, which were filed by all basic prosecution offices and the Special Prosecution Office of the Republic of Kosovo 85.97% of cases completed with condemnatory judgments.

In addition, the Chief State Prosecutor, in cooperation with the Chairman of the Council and the support of partners has drafted an action plan to manage the situation caused by Covid -19, in which case it was possible to mitigate the effects of the pandemic and the State Prosecutor to perform the tasks defined by the Constitution and law.

Based on the statistical data it is evident that the work of the State Prosecutor in the first half of 2020 has been affected by the Covid-19 pandemic in both the number of cases received and the number of cases completed.

The State Prosecutor, in addition to the challenge of organizing work and human resources to deal with the Covid-19 pandemic, also during the first half of 2020 has faced various challenges, starting with the implementation of the electronic case management system (CMIS), number of different criminal cases with unknown perpetrators (PPN, PPP), inherited from previous years, handling cases of war crimes, terrorism, organized crime, corruption, financial and economic crime, strengthening the professional capacity of prosecutors and staff in specific profiles, sequestration and confiscation of property generated by criminal offenses, handling cases through the implementation of alternative procedures, international legal cooperation for war crimes, etc.

However, if we look at it from the point of view of CEPEJ indicators, we can conclude that despite the restrictive measures, which have been present in the work of prosecutors, the efficiency rate has been quite good, respectively 104.44% of cases received in work during this period completed.
