Indictment for Unauthorized ownership and use weapon
Prizren, 27 May 2020 - The Basic Prosecution in Prizren, Serious Crimes Department, has filed an indictment against the defendants with the initials K.B., L.C., and Sh.Z., due to reasonable suspicion that they have committed the criminal offenses of “Unauthorized Ownership, Control or Possession of Weapons” under Article 366 paragraph 1 and “Using the weapon or dangerous instruments” under Article 367 paragraph 1 of the Criminal Code of the Republic of Kosovo (KPRK).
According to the indictment, the first defendant, the K.B, on 30.03.2020 at an indefinite time in the village of Greikoc - Municipality of Suhareka, possesses an Italian-made 9x19 mm caliber pistol, a magazine and a weapon case of the same pistol and 55 9x19 mm caliber bullets, contrary to applicable law on weapons.
With these acts, the defendant K.B., has fulfilled the elements of the criminal offense “Unauthorized Ownership, Control or Possession of Weapons” according to the CCRK.
Whereas, the second defendant L.C., in the period from January to 30.03.2020 in indefinite time in the village Greikoc - Municipality of Suhareka, holds ownership, and on 30.03.2020 gives its possession to the accused K.B., weapon- Italian-made 9x19 mm caliber pistol, a magazine and weapon case of the same pistol and 55 bullets of 9x19 mm caliber, contrary to applicable law on weapons.
With these acts, the defendant L.C., has committed the criminal offense “Unauthorized Ownership, Control or Possession of Weapons” according to the CCRK.
Whereas, the third defendant, Sh.Z., in the time period from January to 30.03.2020 in indefinite time in the village Greikoc - Municipality of Suhareka, possesses a weapon-pistol of Italian production caliber 9x19 mm., A magazine and a case of the same pistol and 55 bullets of 9x19 mm caliber. He also used the same weapon when firing shots with it, in violation of the applicable law on weapons.
With these acts, the defendant Sh.Z., has fulfilled the elements of the criminal offenses “Unauthorized Ownership, Control or Possession of Weapons” and “Using the weapon or dangerous instruments” according to the CCRK.
The prosecutor of the case, upon having filed the indictment, proposed to the Court to find defendants guilty and punish them according to the law, for the criminal offenses as charged.
